1) Introduction & Acceptance

Welcome to Ankit Traders. By accessing https://ankittraders.co.in (the “Site”), placing an order, requesting a quotation, or using any of our services related to construction materials, you (“Customer/you”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or place orders.

Ankit Traders (“we/us/our”) supplies cement, TMT bars, sand, stone chips, and related construction materials to retail and project customers subject to these Terms.

2) Definitions

Products: Construction materials and accessories listed on the Site or otherwise quoted by us.
Order: Your request to purchase Products via phone, WhatsApp, email, in‑person, or through the Site.
Delivery Point: The address you specify for delivery of Products.
Business Day: 09:00–17:00 IST, Monday–Sunday (or as updated on the Site).

3) Eligibility & Account

You must be at least 18 years old and legally capable of entering a binding contract. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account.

4) Products, Prices & Quotations

Product information: Images/specifications are indicative; actual colour, granularity, moisture content, or finish may vary within normal industry tolerances.
Availability: All Products are subject to stock and supplier schedules.
Prices: Prices are in INR and may change without notice until an Order is confirmed. Taxes, duties, tolls, entry/permit fees, and unloading/handling (if any) are charged extra unless stated otherwise.
Quotations: Written/WhatsApp/email quotes are typically valid for a limited time and may be withdrawn or updated at any time before acceptance.
Order acceptance: Your Order is accepted only when we confirm dispatch or issue a tax invoice/Order confirmation. We may refuse/cancel any Order at our discretion (e.g., suspected fraud, pricing error, supply constraints).

5) Payment Terms & Title

Payment modes: UPI, bank transfer, card, cash, or as communicated. Cheque/credit facilities are available only to approved customers.
Due dates: Unless expressly agreed otherwise, Orders are payable in advance before dispatch.
Delayed payment: Late payments may attract interest/charges and suspension of further deliveries until dues are cleared.
Retention of title: Title/ownership to Products passes to you only after we receive full and final payment.

6) Delivery, Risk & Unloading

Service area & timelines: Delivery is available to serviceable locations shown/confirmed during order. Dispatch/delivery times are estimates and not guaranteed. Delays may occur due to traffic, weather, restrictions, or other factors.
Access: You must ensure that roads and the Delivery Point are motorable and legally accessible. If delivery cannot be completed due to site inaccessibility or restrictions, additional attempts/charges may apply.
Unloading: Unless expressly included in writing, unloading is your responsibility. Provide adequate labour/equipment at the Delivery Point. Waiting/detention charges may apply for delays beyond a reasonable time.
Risk: Risk of loss/damage passes to you upon delivery at the Delivery Point (or upon handover to your carrier). Inspect Products at delivery.

7) Strict No‑Return Policy (Damaged/Short Delivery Only)

No returns: Due to the nature of construction materials (e.g., cement, sand, aggregates, TMT), we do not accept returns once dispatched, except for verified cases of damage or short supply at the time of delivery.
How to report: For any damaged/short delivery, inform our team immediately at delivery and within 24 hours, with order details, photos/video evidence, and the driver’s delivery note. Do not use or mix the affected material.
Resolution: After verification, we may arrange partial/full replacement or issue a refund/credit for the affected quantity only. We are not responsible for consequential losses (e.g., labour idle time).
Non‑returnable items: Opened/used cement bags, loose sand/aggregates, custom‑cut/bent TMT, special-order items, or Products altered after delivery are strictly non‑returnable.

8) Cancellations & Changes

Before dispatch: You may request cancellation or modification before dispatch; acceptance is at our discretion and may attract administrative/restocking/price‑difference charges.
After dispatch: No cancellation is allowed after dispatch. If you refuse delivery without valid grounds, you are liable for full value and additional logistics charges.

9) Quality, Storage & Use

Standards: Products are sold as per manufacturer/supplier specifications and applicable industry norms. Minor variations may occur due to quarry/manufacturer batches and moisture.
Storage: You are responsible for proper on‑site storage and handling (e.g., keep cement dry, protect TMT from corrosion, store sand/aggregates to minimize contamination).
Advice: Site information is for general guidance; engage qualified engineers/contractors for structural design and application. We do not warrant fitness for a particular purpose unless confirmed in writing.

10) Warranty & Liability

Limitation: Our maximum liability for any claim relating to a Product is limited to the invoice value of the affected quantity.
Indirect loss: We are not liable for indirect, incidental, special, or consequential loss (e.g., project delays, loss of profit).
Third‑party warranties: Manufacturer warranties (if any) apply as per their terms. We facilitate claims where feasible but do not control manufacturer decisions.

11) User Conduct & Site Use

Permitted use: Use the Site only for lawful purposes and in accordance with these Terms.
IP: All Site content (logos, text, images) is owned by or licensed to us. You may not copy, reproduce, or exploit content without written permission.
Links: External links are for convenience; we are not responsible for their content or practices.

12) Privacy & Communication

Your use of the Site and our services is also governed by our Privacy Policy (available on the Site). By contacting us, you consent to receive service communications via call, SMS, WhatsApp, or email related to your Orders.

13) Force Majeure

We are not liable for any failure or delay due to events beyond our reasonable control (e.g., natural disasters, strikes, lockdowns, regulatory actions, transport restrictions, internet/power outages).

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Subject to applicable law, courts at Vaishali, Bihar (or the nearest competent jurisdiction) shall have exclusive jurisdiction over disputes.

15) Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised Effective Date. Continued use of the Site or services after changes constitutes acceptance.
